Guide for Arbitrators Updates

AF recently introduced the following updates to the Guide for Arbitrators.

Liability Decision/Breach of Duty

  • Further explanation was added on how to address damages when a recovering company argues and proves liability against multiple parties, even with a 100% liability acceptance by one company (pg. 24).

Feature Damages

  • Additional information was added to address calculating and awarding damages when a vehicle has been declared a total loss (pg. 35-36).

Shared Evidence (Auto Only) – Scenario 1

  • Clarified items arbitrators should consider when reviewing and deciding rebuttal evidence (pg. 41).

Credit for Prior Payments

  • Criteria was added for consideration when applying credit for prior payments (pg. 46).
